Judge Rules Against Facebook’s Attempt to Block Lawsuit Over Naked Picture on “Shame Page” – blogged by @MsJennyb

Facebook is facing yet another lawsuit after the company lost a legal bid to stop a 14-year-old girl from suing over a naked picture of her that was posted on a ‘shame page’ on the site,” the #Guardian reports.

On Monday, a judge in #Belfast ruled against the social media platform’s attempt to block the suit, therefore, the Northern #Ireland girl will be allowed to sue #Facebook over the photo.

The girl is also taking legal action against the individual accused of posting/sharing the picture, which is being described as “an act of revenge,” reports state. She will apparently seek damages for misuse of private information, negligence and a breach of the U.K.’s Data Protection Act.

According to the teen’s legal team, the platform had the power to block the republication of the image by using a tracking process to identify the image. However, Facebook’s lawyers argued that they always took the picture down when it was notified, so the claim for damages should be thrown out.

According to reports, the company has also argued that it is a technology platform, and not a publisher. Therefore, it is not fully responsible for the content shared and posted on its site. The case against the platform and the man accused of posting the image will move to trial at a later date, reports state.
