A 31-year-old Colorado woman will not see any jail time under a plea deal over the sexual relationship she carried on with a 13-year-old boy that resulted in a pregnancy.
Andrea Serrano was arrested last summer on charges of sexual assault on a child by one in a position of trust and sexual assault on a child. She was freed shortly after her arrest on a $70,000 bond.
According to the Fountain Police Department, Serrano admitted to the relationship with the teen. Serrano became pregnant due to the abuse and gave birth to a baby boy fathered by the victim.
Under a plea deal, Serrano will avoid jail time but must register as a sex offender. A judge will decide if she will be subject to sex offender intensive supervised probation and for how long. Serrano will find out the terms of her probation in May.
The plea deal does not sit right with the victim’s family, who is outraged that Serrano will avoid jail time.
“I feel like my son is robbed of his childhood,” the teen’s mother told KKTV. “Now he’s having to be a father. He’s a victim, and he’s going to have to live with that for the rest of his life.”
She said the outcome would be different if the tables were turned and a man did the same thing to a little girl. “They would be seeking more,” she told the outlet.
The victim’s family intends to ask the court to hand custody of the baby boy Serrano gave birth to over to the teen. The baby is currently under Serrano’s care.
