The family of Botham Jean is filing a lawsuit for the use of excessive force.
The life of 26-year-old #BothamJean was taken by Dallas police officer #AmberGuyger after she allegedly mistook his apartment for hers and shot him believing he was an intruder.
On Wednesday, attorney Lee Merritt announced Jean’s family will file a federal lawsuit against the city of Dallas and Guyger for the excessive force used when Jean was murdered. Merritt explained the city will be named as a defendant because Guyger was operating “under the color of state authority even though she was off the clock.” ⠀⠀⠀⠀⠀⠀⠀⠀⠀
“She is in uniform, she was wearing a badge, she purports to give commands which he allegedly failed to comply to,” he said. “Clocking in or clocking out has no bearing on that analysis.”
There are no details on when the lawsuit will be filed. Guyger was fired from her position as an officer on Monday.
