The woman who accused Cuba Gooding Jr. of groping her and pinching her butt has won a default judgment against him after he failed to respond to her lawsuit for more than a year.

According to Page Six, the woman identified as Natasha Ashworth filed a lawsuit against Gooding in October 2019, claiming that the academy award-winning actor repeatedly tried to grope her while she was serving him at Tao Downtown Nightclub in 2018.

Court documents show that Ashworth won a default judgment in her suit because Gooding failed to respond in the case.

Gooding also apparently never hired a civil attorney to defend him against the suit. Court records show that to date, no court papers have been entered for him, nor has any lawyer been listed in the case on his behalf.

Manhattan Supreme Court Justice Alexander Tisch granted Ashworth’s request for a default judgment against Gooding on the claims of assault and battery but denied a default judgment on the claim of infliction of emotional distress citing redundancy.

The judge also ordered the case to be set for trial to determine the damages that should be awarded to Ashworth.

On Tuesday, the woman identified as Jane Doe in the court docs filed a lawsuit in New York, alleging that Gooding raped her after she and a friend met him on August 24th, 2013, at a Greenwich Village restaurant. The woman claims that she and her friend went into the VIP area where the actor introduced himself and then invited the women over to his table, according to her Manhattan Federal Court lawsuit. Once they went to sit with Gooding and his entourage, he then invited them to continue the party at The Mercer hotel. Gooding then left the table, and another man, “who appeared to be a security guard,” approached the table to let Jane Doe know that Gooding had requested that she meet him outside in a cab.

Jane Doe checked with her friend before leaving, who informed her that she would meet them separately at the Mercer. Once their cab arrived at the hotel, Gooding instructed her to use the side entrance to “avoid the paparazzi” before they reunited in the lobby. Gooding told Jane Doe that he needed to change clothes to which she replied that she would wait for him downstairs. But she says she was persuaded by Gooding, who told her that he wouldn’t take long. Once the two arrived at his fifth-floor hotel room, Jane Doe reminded him that her friend was on the way “in an effort to suggest that they leave to head back down soon and politely convey that she did not have any interest in staying in his room.” However, Gooding turned on music and blocked the door. He proceeded to undress. Once the woman protested that she needed to leave to meet her girlfriend, Gooding “blocked her from the door and pushed her onto the bed.” That is when the woman alleges that the rape began.

According to court papers, Gooding was nude at that point and began to “forcibly and without consent put one hand in her halter top to touch Plaintiff’s breasts and one hand up her dress” despite her pleading with him to stop. Gooding allegedly ignored the woman’s pleas and touched her genitals before becoming more “physically aggressive,” ultimately vaginally raping her without a condom. After he ejaculated, the woman attempted to escape by crawling off of the bed. However, Gooding emerged from the bathroom and proceeded to rape her anally. Once he fell asleep, the woman went into the bathroom before escaping out of the door when she heard him wake up.
She made it downstairs only to find that her friend was not there but still dining at the restaurant where they initially met Gooding. Jane Doe returned to Greenwich before going home.

Her lawsuit is just the latest allegation against the defamed actor. Thirty women have now come forward so far with sexual misconduct claims against him. He is currently fighting a criminal groping case in Manhattan criminal court.

Gooding’s attorney, Mark Heller, denies that his client raped the woman.

“The allegations are completely false and perjurious,” Heller told Vulture. “The incident never took place, and did not give rise to any criminal complaint seven years back, when it purportedly took place.”

Cuba is facing three counts of forcible touching and three counts of sex abuse to the third degree and has denied all allegations. This Thursday in court, more women came forward with accusations of Cuba touching them without consent.

In the beginning, he was accused of groping three different women at bars in Manhattan during 2018 and 2019. The number of women accusing him of sexually inappropriate behavior is continuing to grow.

The actor’s lawyer, Peter Toumbekis, has reportedly requested to question the women that are accusing Gooding, wanting to ask questions regarding childhood abuse and personal trauma. His lawyer also wanted to ask a particular accuser about a statement she shared about her breast size, bringing up a suggestion that she has a negative self-body image that could have impacted her perception of the situation with Gooding.

“Do you intend to ask the witness what she feels about the size of her breasts?” asked Judge Curtis Farber on Thursday. “I do,” replied Toumbekis. Assistant district attorney Jenna Long called the line of questioning, “Simply offensive.” “Tell me the connection between the size of her breasts and the relevance at trial,” Farber added, as Toumbekis replied, “She actually talks about the fact that she’s self-conscious about her breast size.” He proceeded to call the questions “fair.”

Toumbekis also proposed he wanted to ask an accuser a question concerning an alleged interest in threesomes and open relationships. Farber stated the defense could ask those questions, but only if they were relevant to the case. Gooding’s trial was scheduled to begin back in April originally, but it was delayed due to the COVID-19 pandemic. The next court date is scheduled for Sept. 1, and if found guilty, Gooding could face up to a year in prison.

One of the women claims that while hanging out with Gooding at the Sundance Music Festival in 2009, he began to kiss her forcibly, then proceeded to touch her butt and force his hands on her crotch area. Another woman alleges that ​in 2011, while in Atlanta, Gooding groped her. Allegations such as these, along with claims that Gooding asked multiple women to urinate on him, have run rampant since the beginning of the year.

Gooding and his lawyer, Mark Heller, who has filed documents to dismiss the six-count indictment against him in New York, both adamantly deny the allegations, claiming that “Unfortunately, people come out of the woodwork, making false allegations against Cuba, as often times happens when a celebrity is accused by the District Attorney’s Office in a Public Forum.”

Despite his legal troubles, Gooding recently secured financing for his new film, “Steam.” There is no word yet on whether or not these new allegations will affect the progress of the film.

Gooding’s legal troubles started in June when he allegedly grabbed a woman’s breast at the Magic Hour Rooftop Bar in New York City. ⠀⠀⠀⠀⠀⠀⠀⠀⠀

Gooding was subsequently hit with two misdemeanor counts in that alleged incident, forcible touching and sexual abuse in the third degree, to which the actor pleaded not guilty.

Now, he has been indicted by a New York grand jury with a new and previously uncharged incident added, and the result is that his trial on the original charge that was set to begin today has been postponed and a new arraignment has been scheduled for October 15h.

Manhattan Assistant District Attorney Jenna Long filed a “certificate of affirmative grand jury action” Thursday, according to Justin Henry, spokesman for the Manhattan District Attorney’s office.

Henry said the indictment and the details of the charges will not be unsealed until Gooding’s arraignment on the indictment next week.

The Academy Award-winning actor was originally charged in June with misdemeanor groping stemming from a New York City bar encounter with an unnamed 29-year-old woman. 

His trial was supposed to start in September, But instead, the case was postponed because prosecutors said they were still waiting for evidence in the case.

Gooding’s New York defense attorney Mark Heller told USA TODAY in an email that the defense was “ready for a trial” this week. He did not immediately return a call requesting comment on the new developments.

Gooding has pleaded not guilty, insisting that “nothing happened.”

Cuba Gooding Jr. trial date has been set over the allegations of him groping a 29-year-old woman at a rooftop bar in New York this past June. The judge decided not to dismiss his criminal case, and instead set a date for next month to begin the trial. 

Gooding is being charged with forcible touching, a misdemeanor, and sex abuse to the third degree, all of which he denies. If convicted, he could face up to a year in jail, according to an article in USA Today.

If you missed it, the case stems from a night out where a woman claims Gooding drunkenly grabbed her breast. However, he argues that nothing happened, and he and his team believe he will walk away free. However, Judge Chu believes the trial is necessary as this is a “rare case.”

According to CNN, the trial date is for September 3, 2019, in New York.

Just days after Cuba Gooding Jr. surrendered to police following accusations of groping a woman at a New York City bar, the actor is defending himself again over a new claim. This time, the woman is a blogger/comedian named Claudia Oshry who said the actor molested her in 2012 when she was just a teenager.

Oshry discussed the alleged assault on “The Morning Toast,” a podcast she co-hosts, last week. She said she was 16 years old when Gooding “put his finger up my butt.” Oshry later elaborated during an interview with ‘Entertainment Tonight,’ saying the assault happened inside a club in New York while at a table with her friends. She said, “…I felt someone inappropriately touching me… I turn around, and Cuba Gooding Jr. is there hysterically laughing. I was mortified.”

“Nobody had ever touched me without my consent before. I wasn’t planning on turning around and seeing a celebrity, just your average NYC degenerate,” Oshry said. She admitted that she didn’t contact authorities about the incident because she was afraid she’d “get in trouble for being at a club underage and using a fake ID.”

She said a few people in her life knew what happened, but she mostly used the experience as material for her stand-up routines. “Now I use it as a shtick in my show on tour,” she said on her podcast. “Like, you really want to put a finger up my butt? Without my consent? Fine, but I’m going to use it for all that it’s worth.”

According to People Magazine, Gooding’s attorney, Mark Heller, said in a statement that the actor denies Oshry’s allegation.

Heller stated, “Mr. Gooding told me such an event never happened. He doesn’t know this individual.”

Oshry told ET that she’d been contacted by at least five women who claim to have shared similar incidents of sexual misconduct against Gooding. “I think lots of people are embarrassed to speak on this,” Oshry said.

In a video posted by TMZ, Gooding maintained his innocence. The Oscar winner said that while he was partying with friends at Magic Hour Rooftop Bar & Lounge, he met people and took pictures with fans, but he never touched anyone inappropriately, and he said there’s video proof.

“I trust the system, let the process speak for itself,” Gooding told TMZ. “There’s a tape that shows what really happened — that’s the most important thing.”

According to TMZ, sources close to the 51-year-old say Gooding will surrender himself to detectives at Manhattan Special Victim’s Unit on Thursday and expects to be arraigned on a misdemeanor charge for forcible touching.

Not only is Cuba Gooding Jr. a force to reckoned with in front of the screen, but he apparently is very talented behind the scenes.

The Oscar-winning actor has received a full financial backing from Wudi Pictures to direct and star in a thriller set to begin filming in early 2019, according to Variety. This will be Cuba Gooding Jr.’s second directorial effort with his first being “Bayou Caviar”, which was financed by the same company.⠀⠀⠀⠀⠀⠀⠀⠀⠀

Although the film is still in its early stages, Gooding revealed “the film is a modern-day thriller about a family man who, after experiencing a life-altering event, must find the courage to pick up the pieces of the rest of his life. In doing so, he will change the course of events for not only his life  but also for those around him… including the ones he loves, ” Variety reports.

Cuba Gooding Jr. is known for his role in” Jerry Maguire”, “Boyz N The Hood”, and most recently “The People v. O. J. Simpson: American Crime Story.”

22 years is a long time to be married and then suddenly call it quits, but Cuba Gooding Jr. has done just that.

Despite appearing together at a Golden Globes after party recently, People v. O.J. Simpson actor, Cuba Gooding Jr,  has officially filed for divorce from his estranged wife Sara Kapfer. Apparently, this wouldn’t be the first time these two attempted to split. Sara originally filed for a separation back in 2014.

Gooding is asking for joint legal and physical custody of their youngest child, 10-year-old daughter Piper. He is willing to pay spousal support however, there is a catch. Since Kapfer filed for separation in 2014, Gooding wants all the earnings he made from then until now to remain his and his alone.  In other words, he doesn’t want her to see a penny of his O.J. checks.

Gooding and Kapfer , a school teacher, were married in 1994. They share three children, two are now adults.
