The New York Times published research that contains data regarding the number of deaths that occurred in police custody after detainees said, “I Can’t Breathe.” According to the report, at least 70 people have died in law enforcement custody after pleading that they couldn’t breathe. The victims ranged in age from 19 to 65. Even more troubling is that more than half of them were Black and came into contact with the police due to “nonviolent infractions.”

The NYT report from Mike Baker, Jennifer Valentino-DeVries, Manny Fernandez, and Michael LaForgia, also points out that not all cases involved police restraints. Instead, according to the report, many cases stem from the fact that law enforcement often doubts claims of having trouble breathing during an arrest. Instances of cops being spared of murder charges when a victim clearly expressed breathing difficulties is accurate for nearly ever example, despite autopsies repeatedly identified links between the actions of officers and the deaths of detainees who struggled for air. Government investigations often declared that the officers were justified in their actions.

The report mentions Byron Williams, who was murdered when police stopped him when his bicycle did not have lights on it. Officers used their hands and knees to pin him down, ignoring pleas of “I can’t breathe.” Eric Garner said the same three words in 2014 when he was murdered on the New York sidewalk for selling cigarettes. And most recently and now the most famous, George Floyd who was murdered when an officer held his knee against his neck after he allegedly paid at a deli with a counterfeit bill.

Wisconsin Gym Under Fire For Posting an “I Can’t Breathe” Workout; Owner Apologizes

In the words of Dr. Phil, “common sense ain’t so common.” Even though we cannot fret over the fact that intelligence was not equally distributed, it’s still frustrating to know people don’t have enough sense to not mock death.

Jen Dunnington, co-owner of Anytime Fitness, a gym in Wauwatosa, Wisconsin, is now apologizing after receiving major backlash over a workout titled “I can’t breathe.” According to Dunnington, a trainer at the facility wanted to “honor” Floyd by posting the workout to gym-goers.

Dunnington told TMZ that the workout was supposed to be “so hard that we felt what he felt,” but the whiteboard, which had a drawing of a man kneeling and the words “don’t you dare lay down” was considered inappropriate and appalling by hundreds in the community.

“I deeply apologize,” the co-owner said, admitting she deeply regrets the sign. “I was not aware of the signage that it was posted in that way,” she said. “I didn’t read it in that way, but I do definitely apologize that those words were on there.”

However, an apology video on the gym’s social media page has since been taken down, and workers at the facility stand by their statement that they did not mean to offend anybody. In fact, Dunnington and the gym thought that applying the “I Can’t Breathe” verbiage would motivate members.

But, a spokesperson from Anytime Fitness corporate office says the decision to post the sign was “shocking and devastating.”

“No matter the intent, we absolutely do not condone the words, illustrations, or actions this represents,” the Anytime Fitness officials said in a statement Wednesday. “To our employees, owners, and members, we are truly and profoundly sorry that this incident occurred.”

They continued, “One of our publicly-stated commitments to antiracism work is to bolster education efforts for our franchise owners to lead with empathy, love, and respect. This incident makes it clear that we have work to do in this space; immediately, we are sharing this incident with our franchise owners worldwide as an example of what not to do, why it is offensive, and what locations should be doing instead.”

“We remain committed to working to inform and educate employees and owners worldwide to stand for our black communities, including our members and employees. We are committed to listening and learning, so that we can take action that helps our communities heal and grow in real and meaningful ways.”

The NYPD cops responsible for the murder of #EricGarner “will immediately begin” an internal disciplinary trial.

On Thursday, an NYPD department spokesman said Officer Daniel Pantaleo and Sgt. Kizzy Adonis “will immediately begin an internal disciplinary process for the 2014 choking death of 43-year-old EricGarner. “The U.S. Department of Justice yesterday for the first time officially confirmed to the NYPD, to [Deputy Commissioner for Legal Matters] Larry Byrne, that there was no objection to moving forward,” the statement said. “The proceedings themselves will commence in the coming days.”

Pantalelo, the officer who placed Garner in a chokehold, is expected to be served in the next two weeks, according to his attorney.  “They (NYPD) first have to serve my client with departmental charges and that hasn’t happened yet,” Stuart London told CNN.
Pantaleo’s case will be prosecuted by the Civilian Complaint Review Board, while Adonis’ will be led by the NYPD Department Advocate’s Office. Since Garner’s death, Pantaleo has been on desk duty. Adonis returned to full duty after being on modified status until last May.

The disciplinary actions taking place still are not enough for Garner’s mother, Gwen Carr, who says the investigation is inadequate. In a statement she wrote:
 “It’s unacceptable that the NYPD is saying that only two officers will face discipline charges when many more were involved in murdering my son, trying to cover it up and other related misconduct. There were over 5 officers on video using force or failing to intervene as my son Eric pleaded, ‘I can’t breathe,’ 11 times,” she said. “Some officers tried to cover up the killing by lying on the official police reports to leave out the kind of force used against him and others illegally leaked alleged information,” she added.

“It’s past time for de Blasio and the NYPD to stop playing games with my son’s death and release the names of all the officers responsible for his murder, [or who] tried to cover it up and engaged in other related misconduct, and bring disciplinary charges to fire all of them.”
