Kim Kardashian is a multi-millionaire with millions of fans that support her, so if you think she needs to steal from another makeup artists to get sales, she says, think again.
In new legal docs obtained by The Blast, Kim K is firing back at Kirsten Kjaer Weis over her trademark infringement lawsuit against the reality star. In the initial suit, which was filed last year, the Danish makeup artist accused Kim of infringing on her international KW Cosmetics trademark with her KKW product line.
As part of the lawsuit, Weis demanded an injunction to cease all future sales under the KKW mark, as she argued that it was an intended to “dupe customers and screw” with her bottom line. She also asked for all profits made off the line, plus additional damages. ⠀⠀⠀⠀⠀⠀⠀⠀⠀
But now, in response, Kim says she’s just too rich and famous to steal from anyone to further her own business.
According to The Blast, in new docs filed on October 22, the reality star denied the allegations and demanded the lawsuit be tossed, claiming the evidence obtained proved there is no case. She says she is a “world-famous television celebrity” and had no intentions to dupe the public with her own initials.
Furthermore, Kim says Weis has seen “historically modest sales” since 2010, and neither party has had a customer who has confused KKW Beauty with her KW Cosmetics line.
“The absence of a shred of evidence showing real customers suffering actual confusion is enormously telling and weighs heavily in favor of a finding that there exists no likelihood of confusion as a matter of law,” she said in the response, adding that the products look nothing like.
“Considering Kardashian’s fame and access to over 100 million social media followers, no rational inference can be drawn that she would need or want to trick the public into associating her products with Kjaer Weis in order to gain exposure or traction,” she continued, pointing out the fact that Weis targets high-end consumers, while her KKW line targets lower-end customers with cheaper products.
The reality star wants the case dismissed.
