Dashcam video released this week shows a graphic accident in which a Michigan sheriff’s deputy patrol car hit and killed an 11-year-old boy on a minibike.
Norman Hood Jr. passed May 28 due to his injuries as a result of the accident in Battle Creek, MI.
According to NBC News, The Calhoun County sheriff’s deputy was responded to a report of a possible burglary. Investigation reports gathered by the Jackson County prosecutor’s office say he fatally struck the boy traveling 66 miles per hour, which was double the speed limit, without flashing lights or a siren.
The investigation also found that the cop “is not responsible for a criminal act.” As a result of the incident, the officer who wishes to remain unidentified will not face charges.
“It is my opinion that this was a tragic accident,” Jerard Jarzynka, Jackson County Prosecuting Attorney said, adding that in such a situation, a police officer can “legally exceed the speed limit to perform his duties.”
Norman’s mother, Christina Valadez, shared with NBC News that she believes officials are now blaming her for the death of her son.
“I don’t think the officer was looking at the road because if he was looking at the road, he could have hit the brakes, he could have swerved,” Valadez said.
She also declared the issue of the deputy not having his flashing lights or siren on.
“How can you warn pedestrians you’re traveling at a high rate? How do you expect anyone to know?” she said. “How was he to hear or see the cop coming? How can you not be at fault for that?”
Michigan State Police released the video showing Norman riding his pocket motorcycle, also known as a minibike. Investigators are claiming Norman rode into the path of the patrol car.
Valadez stated the family will be suing the county and the deputy for $25 million.
