Kodak Black wants a judge to reconsider his gun charge sentence because he believes it’s too harsh.

In new federal documents, rapper Kodak Black says the judge that sentenced him to three and a half years for lying in order to obtain guns illegally is mistaken because he is technically not a convicted felon. Kodak’s team filed the documents on Feb. 12 and claimed that the judge mistakenly gave the 22-year-old the wrong sentence based on certain guidelines.

According to @officialbossip, Kodak’s team wants to know if the court made a mistake when sentencing the Florida native under the terms for a convicted felon. His legal team said Kodak pleaded “no contest” in a previous case that involved a strong-arm robbery in Florida, and the courts ultimately decided against convicting him. The decision allowed him to maintain his civil rights and be able to have the case closed.⠀⠀⠀⠀⠀⠀

Kodak’s argues that since he was never convicted in his robbery case, he should not have to be sentenced under guidelines that are specifically for convicted felons. Kodak was arrested last year on charges of making a false statement in the acquisition of a firearm when he tried to purchase a semi-automatic weapon from a dealer, Bossip reports.

Kodak was sentenced to 42 months in federal prison and three years on probation after taking a plea deal back in November 2019. While imprisoned, Kodak has complained about the conditions saying the guards have made him a target for abuse and that he’d been drugged. Authorities have yet to respond to Kodak’s filing.
