Authorities in Orlando, Florida have made a second arrest in the fatal shooting of a Burger King employee named Desmond, who was reportedly on his second day on the job.

On Wednesday, a 31 year old woman named Ashley was arrested and charged with principal to first degree murder and aggravated assault with a firearm. Her husband, Kelvis, had been arrested three days earlier in the shooting and also faces a destruction of evidence charge and a charge of possessing a firearm as a convicted felon, according to the arrest affidavit.

The affidavit says the incident began when Ashley became upset about the wait in the drive thru. After an argument with Desmond, she was refunded and asked to leave. Investigators say she then called her husband, said the crew had been disrespectful, and told staff he was coming to talk to them.

According to the affidavit, Ashley first told investigators she had gone home before returning. Surveillance video from a neighboring restaurant reportedly showed her parking at the Burger King to wait for him. The affidavit says a fight broke out when Kelvis arrived, that she handed him a handgun after the fight was broken up, and that he used it to shoot Desmond moments later. It also cites employee accounts and cell phone video in which a man can be heard threatening to shoot. Desmond was pronounced dead at a hospital.

The affidavit also describes Ashley’s own account, in which she said she picked up the gun from her husband’s truck and later gave it to him. Investigators say her account minimized her role. The charges are allegations, and neither person has been convicted. Responses from the defendants were not included in the reports.

Our thoughts are with Desmond’s family and coworkers.
