A US District Judge dismissed a suit seeking to give Mike Pence power to overturn the 2020 election results after saying the plaintiffs lacked “standing” and alleged “an injury that is not fairly traceable” to VP Pence.
According to the Daily Mail, Texas US District Judge Jeremy Kernodle, who was appointed by Donald Trump, threw out a lawsuit brought forth by Rep. Louie Gohmert (republican) and Arizona’s slate of ‘alternate’ Electoral College electors.
Gohmert’s lawsuit attempted to give Mike Pence the power to overturn the presidential election during a formal count of the votes happening next week on January 6th.
Biden’s win has already been cemented in December, by the Electoral College in a 306-232 victory, despite multiple legal efforts by Trump’s campaign to challenge the results.
Gohmert’s suit named Pence, who essentially has a largely ceremonial role in next week’s proceedings, as the defendant and asked the court to throw out the 1887 law that clearly spells out how Congress handles the counting of the votes.
Gohmert, a Republican from Texas, argued that Pence is more powerful than a “glorified envelope-opener in chief.”
‘Under the Constitution, he has the authority to conduct that proceeding as he sees fit,’ Gohmert argued.
