DOJ Asks Federal Court to Block Enforcement of Texas Abortion Law

Texas Attorney General Threatens Prosecution for Doctors in Emergency Abortion Case

The Department of Justice filed an emergency order yesterday asking a federal court judge to block the enforcement of the new Texas abortion law temporarily.

In the filing, the DOJ said the new law, known as S.B.8, prevents “women from exercising their constitutional rights.”

“The United States seeks a temporary restraining order or a preliminary injunction enjoining the enforcement of S.B. 8,” the filing stated. “This relief is necessary to protect the constitutional rights of women in Texas and the sovereign interest of the United States in ensuring that its States respect the terms of the national compact. It is also necessary to protect federal agencies, employees, and contractors whose lawful actions S.B. 8 purports to prohibit.”

The Justice Department claims the new law, which took effect two weeks ago in the state, violates the 14th Amendment.
