Andrew Cuomo is determined to see that the Albany sheriff who filed charges against him “preserve all records” from the investigation. However, the lawman called out New York’s ex-governor and his camp, saying they were “bullies.”
On Saturday, Cuomo tweeted a letter that was sent from his attorney Rita Glavin to Sheriff Craig Apple, which demanded Apple “preserve all records” from the investigation surrounding claims that he groped an aide.
A misdemeanor criminal complaint was filed this week, the New York Post reported.
Glavin listed records that need to be maintained, including correspondence with Brittany Commisso, the former executive assistant who accused the former governor of groping her in the Executive Mansion. The attorney also requests the handover of correspondence from Commisso’s estranged husband Frank Commisso, Jr. and his father, a former Albany County Democratic Majority Leader, and records of correspondence with the press.
“They’re bullies,” said Apple in an interview with The Post Saturday. “But we expected this.”
Cuomo, 63, has been accused of “forcibly” putting his hand under the aide’s shirt and grabbing her in the December 7 incident. He has been summoned to appear at Albany City Court next month.
“If he doesn’t show up the stakes will be raised,” Apple said. “They’re bullies. They keep doing what they do, and we’re going to continue to move forward with our investigation. People can see through that smoke screen. We’ve tried to keep this from being a circus but they’ve turned it into a circus.”
Allegedly there is evidence against Cuomo, including a text from his cellphone, state police aviation records, and more.
“What occurred here was a clear abuse of power by Sheriff Apple and we plan to get to the bottom of it,” said Cuomo’s spokesman Richard Azzopardi stated in a comment on Twitter.
