Former New York Governor Andrew Cuomo won’t face criminal charges stemming from two sexual misconduct allegations against him, despite “credible evidence” that such events occurred.

The district attorney’s office in Westchester County made the announcement Tuesday stating that the accusations fell outside the statute of limitations.

“Our investigation found credible evidence to conclude that the alleged conduct in both instances described above did occur. However, in both instances, my Office has determined that, although the allegations and witnesses were credible, and the conduct concerning, we cannot pursue criminal charges due to the statutory requirements of the criminal laws of New York,” Westchester County DA Miriam Rocah said in a statement.

Two women accused the ex-governor of inappropriate conduct, specifically kissing their cheeks while he was governor. Rocah’s office was responsible for reviewing the two allegations that took place in her district.

The probe looked at allegations from a report by the state attorney general’s office that concluded Cuomo had sexually harassed 11 women while serving as governor.
