In Germany, an unnamed woman has been arrested after she secretly poked holes in her lover’s condom in an attempt to get pregnant.
“We have written legal history here today,” Judge Astrid Salewski told the court.
Since 2021, the offender had been in a “friends with benefits” relationship with the victim, and they would meet up for sex regularly. Her lover, on the other hand, preferred their informal arrangement and did not share her desire for a deeper bond.
That’s when she made the decision to poke holes in her partner’s condoms without his knowledge or consent.
According to DW, the woman never got pregnant but admitted in a WhatsApp conversation to tampering with his condoms.
When the woman’s husband pressed charges, she confessed to “stealthing” in court.
Despite recognizing that she had committed a crime, the judges were initially undecided about the charges they should bring against her due to a lack of precedence.
After reviewing the crime of “stealthing” in a legal document, lawmakers changed the charge from rape to sexual assault.
While men frequently commit the offense, Judge Salewski reasoned that the “provision also applies in the reverse case.”
“The condoms were rendered unusable without the man’s knowledge or his consent,” she declared. “No means no here as well.”
