On Thursday, Atlanta rapper Gunna was denied bond for the third time since his arrest in May.
The rapper, whose real name is Sergio Kitchens, was one of more than two dozen people arrested and charged in a 56-count indictment linked to Young Thug’s YSL group and label. While some members were slapped with multiple charges, including participation in criminal street gang activity, Gunna is facing a single count of conspiracy to violate the RICO Act.
The conspiracy charge stems from an incident that occurred in January 2013, while the other charges have been linked to an alleged incident that occurred on May 12, 2018. However, according to a recent filing obtained by Rolling Stone, Gunna “has been dropped from overt act 75” of the indictment, which refers to the 2018 incident where he and Thug were stopped for speeding and weapons were recovered.
Despite the updated filing, Fulton County Superior Court Judge Ural Glanville is still not convinced that the “Pushin’ P” rapper will not pose a threat. In fact, Gunna’s two previous motions were denied over concerns of witness intimidation.
But, according to Rolling Stone, the rapper’s lawyers have argued that an “ongoing investigation” has yet to find evidence to validate the judge’s concerns. Now, with the updated indictment, his lawyers say, “the DA has pruned the indictment in the superseding indictment to remove virtually any reference to Kitchens’ involvement in any violence-related offense.”
In the meantime, the case is set to go to trial in January of 2023.
