The family of a 19-month-old toddler who died from apparent exposure to fentanyl while staying at an Airbnb is legally going after the company and property.
Enora Lavenir, 19 months, died in 2021. The toddler was traveling with her family and staying at the rental.
Lavenir’s family is suing Airbnb, the property owner, the manager of the rental, and a renter who had hosted a party in the Wellington, Fla. unit two weeks before the family checked-in to the rental, the Washington Post reported.
According to PEOPLE, authorities have not charged anyone and could not find evidence of the drug at the property or on the child’s parents.
In August 2021, the toddler’s mother found her dead in the home. Her face was blue with white foam coming out from her lips.
A Palm Beach County medical examiner and an independent toxicology report concluded that she had died of a lethal amount of fentanyl.
“It’s like we fell into a trap,” Boris, the girl’s father, told the publication in French.
Authorities still don’t know how the child got a hold of the lethal substance.
“I am unable to develop probable cause for abuse or neglect leading to the death of Enora,” one investigator noted. “Currently the manner of death is listed as accidental.”
The family claims Airbnb and those behind the home rental didn’t properly clean up after the party, which resulted in the toddler’s death.
Thomas Scolaro, the attorney representing the family, has made his number one priority to find the source of the drugs, adding that the “only thing we have here is common sense.”
“It was definitely in that unit, that Airbnb,” he added. “Which particular person left the drugs is frankly not anything I’m trying to prove. What I want to show is Airbnb provided no cleanup, no warning, no measure of safety for the family.”
