Brooklyn-based rapper Fetty Luciano will no longer have to fight an attempted murder charge related to a 2002 shooting at a Long Island pool party.
The 27-year-old, real name Remy Marshall, was arraigned Friday on a nine-count indictment that did not include the attempted murder charges prosecutors originally sought. The prosecution said they did not have enough evidence to pursue the attempted murder charge.
Instead, he was charged with three counts of second-degree assault and one count each of criminal possession of a weapon and attempted second-degree assault. He was additionally charged with misdemeanor counts of assault and reckless endangerment.
Luciano pleaded not guilty to the charges. His attorney, Javier Alberto Solano, believes that the lack of evidence on the attempted murder charge indicates the “beginning of the end” of the case. He says there is no video evidence of the shooting and that eyewitnesses who identified his client are mistaken.
But prosecutors maintain that Luciano took out a gun during an argument inside the Mansion at Glen Cove during a birthday celebration for Big Fendi, and the gun went off.
“During that event, the gun discharged, and a single bullet hit three different victims,” prosecutors said. A security guard was one of the three people injured during the shooting. No one was seriously hurt.
The shooting cost the venue, which also caters to weddings and fundraisers, its liquor license during the busy wedding season. It prompted Glen Cove Mayor Pamela Panzenbeck to restrict future permits at the Mansion at Glen Cove.
Luciano faces up to 15 years in prison if convicted on the top count. He has another court appearance scheduled for the end of March.
