TikTok Prepping U.S.-Only App as Mystery Billionaire Squad Eyes Buyout

On Friday, Montana lawmakers approved SB 419 in a 54-43 vote, which is the most significant step taken by a state so far in opposition to TikTok. The bill prohibits app stores from offering the option to download the app. It also makes it unlawful for the company to operate in the state.

It is important to note that despite the bill’s passing, individuals who already have TikTok are not prohibited from using the app. The bill initially included language that would require internet providers to block access to TikTok. But this provision was ultimately removed.

If the ban is violated, users could face a $10,000 penalty. The responsibility of enforcing this ban would fall on the Montana Department of Justice. However, it remains unclear on how law enforcements will enforce the policy.

“The bill’s champions have admitted that they have no feasible plan for operationalizing this attempt to censor American voices. And that the bill’s constitutionality will be decided by the courts,” a TikTok spokesperson said. “We will continue to fight for TikTok users and creators in Montana whose livelihoods and First Amendment rights are threatened by this egregious government overreach.”

As of now, the bill is headed to Gov. Greg Gianforte desk to be signed. If passed, the bill will go into effect in 2024.
