Travel nurse Nicole Linton has been hit with a wrongful death and negligence lawsuit filed by the family of Nathesia Lewis concerning the August 2022 Windsor Hills car crash that claimed six lives, RadarOnline reports.
Linton has been charged with six counts of murder and five counts of vehicular manslaughter for a high-speed crash in LA last year, where she hit speeds of up to 130 mph, leading to the deaths of five people and an unborn baby.
Lewis’s sister, Jasmond Nelson, stated on her GoFundMe campaign that her sister had been severely burned and had to be identified through DNA. She left behind six children, ages two to 23.
The recent lawsuit lists Linton, AMN Healthcare Services Inc., its subsidiaries, and Kaiser as defendants. The plaintiffs seek compensation for economic losses, including lost wages, legal expenses, punitive damages, and other appropriate relief.
Court documents say that the defendants are accused of knowing that Linton displayed concerning behavior, making her ineligible for nursing work under the California Board of Registered Nursing guidelines and the California Business and Professions Code.
Additionally, She was reportedly “agitated at work” just before the accident and allegedly became “increasingly unstable” and “displaying signs of a mental health crisis.”
The plaintiffs argued that Linton’s history of multiple car accidents, along with incidents like jumping on a police car and leaping out of a window, should have made it clear that employing her as a traveling nurse posed a risk due to her previous manic episodes.
Linton pleaded not guilty to six counts of murder and five counts of vehicular manslaughter in March. She is currently held in a county jail without bail.
Lewis’ family is also requesting a trial conducted by a jury and seeking unspecified damages.
According to Linton’s defense attorneys, they plan to call a neurologist specializing in epilepsy and seizures to testify that Linton had a seizure and became immobile while driving that day.
“Everything that the doctor has reviewed is consistent with her having a seizure. Nicole wasn’t sleeping for days, and insomnia can cause seizures,” said Linton’s attorney, Jacqueline Sparagna.
