Prosecutors allege that Tupac murder suspect Duane “Keefe D” Davis and his son conspired to harm witnesses set to testify against him during a jail phone call.
In audio obtained by ABC News affiliate KTNV, Davis can be heard in a conversation with his son, using the term “green light.” Prosecutors argue in the court docs that, in Davis’ world, a ‘green light’ is an authorization to kill.” which “caused enough concern that the Federal Government stepped in and provided resources to at least [one witness] so he could change his residence.”
Prosecutors said this is evidence that Davis poses a threat even from behind bars. Nevertheless, there’s a possibility that he might be released from jail and placed under house arrest until his June trial, following a judge’s decision to set his bail at $750,000 earlier this month.
During an October 9 phone call between Davis and his son, discussions apparently revolved around an “authorization to kill.”
“I got something to tell you about some s— that’s going on,” prosecutors quote Davis’ son telling his father on the call.
Davis asks, “About what?”
Per prosecutors, his son replies, “Around the city, they talking about it’s a green light on our side.”
Davis asks, “Our side? It’s a green light on our side?”
His son replies, “Yeah, that’s what he told him, he said n—-, we was raised in war, we don’t give a f—.”
Davis then asks, “For wha – for this here?”
The son replies, “B-Rue, yea … he’s saying that ‘it’s on,'”
“Aw …” Davis says in response.
Davis’s attorney told ABC Wednesday that prosecutors had misconstrued what was discussed on the call and that his client had not planned a hit out on anyone.
“It is clear that in the phone call, our client Mr. Davis does not threaten any witnesses whatsoever,” Charles Cano and Robert Arroyo, chief deputy special public defenders for Clark County, told ABC News. “Our interpretation of that phone call is that his son was warning him about a threat towards him and / or his family.”
Davis was arrested last September for the murder of rap icon Tupac Shakur.
