Diddy’s Legal Team Pushes for Mistrial, Says Evidence Proves He Didn’t Dangle Witness from Balcony

Lawyers for Diddy are once again urging the judge in his sex trafficking case to declare a mistrial, this time accusing federal prosecutors of using “demonstrably false” evidence in court.

In a letter filed Saturday, defense attorney Alexandra Shapiro alleged prosecutors misled jurors with testimony from Bryana Bongolan, a longtime friend of Cassie Ventura, who claimed the mogul dangled her off a Los Angeles balcony in 2016.

“The government knew or should have known this testimony was perjured, and that Ms. Bongolan could not possibly have been injured by Mr. Combs on a Los Angeles balcony in the early morning hours of September 26, or even the day before that,” Shapiro wrote.

Diddy’s legal team presented hotel receipts placing him in New York from September 24th to 29th of that year, directly contradicting Bongolan’s timeline. Still, Bongolan stood by her claims. Prosecutors argued the incident could have occurred before those dates and that the account showed Diddy as “an angry and dangerous man who terrified Ms. Ventura and her friends.”

This is the second mistrial motion in the case. The previous one, rejected by Judge Arun Subramanian, came after prosecutors questioned a witness about fingerprint evidence tied to the arson of rapper Kid Cudi’s car. Diddy’s team said that line of questioning implied he tampered with the investigation.

Saturday’s letter also objected to testimony from Diddy’s former assistant, “Mia,” who said she avoided speeding tickets by using Diddy’s name, another moment the defense called prejudicial.

Diddy, who denies all charges, faces life in prison if convicted.
