Bill Cosby’s lawyers are putting the actor’s age into play in the latest update in his case against Andrea Constand.
Andrea Constand is the #TempleUniversity employee who claims Cosby drugged and raped her in 2004. Cosby faces three charges of felony indecent assault and 10 years in prison.
Cosby’s lawyers argue that his age and health aren’t where it used to be and it wouldn’t be fair to put him on the stand.
“No 79-year-old blind man could possibly defend himself against a claim that he sexually assaulted someone he supposedly met once, half a century ago,” the attorneys claim in the October 27th filing.
“Without his eyesight, Mr. Cosby cannot even determine whether he has ever even seen some of his accusers, let alone develop defenses and gather exculpatory evidence,” the documents further state.
Cosby has reportedly registered with a state commission for the blind, and will provide a doctor’s report to the court at the pretrial on November 1.
