The family of singer D4vd is pushing back against a California court order that would require them to testify before a grand jury.
According to new legal documents obtained by TMZ, prosecutors want D4vd’s mother, father, and brother to appear in California as part of an ongoing grand jury investigation. However, the family is challenging the order in court.
Dawud, Colleen, and Caleb Burke, who all live in Texas, argue that the order violates their due process rights. In their filing, they claim they were provided only redacted versions of the affidavits used to support a lower Texas court’s decision compelling their testimony in a California grand jury proceeding.
The matter is tied to the Celeste Rivas murder case. A grand jury has reportedly been convened since at least November, and multiple witnesses have already testified. Sources previously told TMZ that D4vd is likely to be charged with Celeste’s murder, though no charges have been publicly announced.
In their challenge, D4vd’s parents and brother contend that because the affidavits were redacted, they had no information explaining why they would be considered material witnesses. They also argue they were not given the opportunity to challenge the trial court’s determination that they are, in fact, material witnesses.
The legal dispute could move quickly. An appeals court has given the trial court judge 10 days to respond.
At least two witnesses have already appeared before the grand jury in the Rivas case, including Robert Morgenroth, president of D4vd’s touring company, and popular streamer Neo Langston, who was previously described as a friend of the singer.
