The Fawn Weaver Uncle Nearest bankruptcy ruling just got even heavier with new details from court filings.
A federal judge has already blocked Fawn Weaver’s attempt to use bankruptcy to regain control of Uncle Nearest. However, the motion tied to that decision lays out serious allegations about how the company was handled before the court stepped in.
So here’s the backstory behind the motion to dismiss. Farm Credit Mid-America, the lender suing over more than $100 million in debt, asked the bankruptcy court to throw out the Chapter 11 filings. The lender argued Weaver had no authority to file because a federal receivership order gave full control of the company to court-appointed receiver Phillip G. Young Jr.
That order didn’t just limit her role. It stripped her of corporate power entirely, meaning only the receiver could make major legal moves like filing for bankruptcy.
But the motion goes further than just authority. It also claims the bankruptcy filings were made in bad faith, describing them as an attempt to get around the court’s receivership and regain control through a different legal lane.
Then come the fraud-related allegations.
According to the filing, Weaver allegedly diverted millions tied to a $20 million note deal involving MarcyPen, a company connected to Jay-Z, into a separate account linked to another entity. The motion states she testified under oath that the move was meant to keep those funds from being accessed by the lender.
The document also points to concerns about financial management. It alleges the company failed to file tax returns for years, operated without proper financial controls, and commingled assets across related entities.
Because of that, the lender argues there is clear evidence of mismanagement and fraudulent conduct, which it says justifies either dismissing the bankruptcy entirely or putting the receiver in full control as a trustee moving forward.
Weaver’s bankruptcy move doesn’t stand, the receivership has not ended, and the deeper legal fight over control, debt, and those allegations is far from over.
