Alabama Woman Order to Pay Ex $32K for Wedding Ring She Pawned for $10K

A woman in Alabama called off her wedding and then sold the diamond engagement ring at a discounted price, resulting in a legal dispute with her ex-fiancé.

Earlier this month, the state‘s appeals court ruled that the woman should compensate her ex for the ring he bought for $32,000, which she then turned around and pawned for $10,000. 

According to court documents, the man proposed to his then-live-in girlfriend on Christmas Eve 2018 by presenting her a holiday gift bag containing a 2.5-carat diamond ring.
Although the woman testified that he never officially proposed marriage, the man claimed he got down on one knee and popped the question.
Court documents further stated that after she moved out in September 2019, she took the ring with her – then refused to give it back and initially claimed she tossed it in a local waterway. When she lost her job amid the COVID-19 shutdown in 2020, she allegedly sold the ring to “an individual”.

A lower court judge ruled earlier this year that the ring was an unconditional gift in law, and her ex-fiance lost his lawsuit. In its appeal, the Alabama appeals court vacated the lower court‘s ruling and ruled that an engagement ring is a gift conditional on the marriage going through.

“We agree that, when an engagement is terminated, the donor has the right to request the return of the engagement ring and that, when such a request is refused, an unjust enrichment cause of action exists,” the appeals court ruled, according to the records, obtained by the Charlotte Observer.
