The debate over Jeffrey Epstein’s files is making the rounds again and many are asking why former President Joe Biden did not release the documents while in office especially if they included Donald Trump. The truth is Biden never had the legal power to unseal those records and neither does the current administration.
From 2021 through 2025 when Biden was president the Epstein files were under strict federal court orders. Federal judges controlled the records to protect the privacy of trafficking victims including minors. Biden could not overrule those protections and no president can bypass federal judges to release sealed court evidence to the public.
The Department of Justice also reviewed the Epstein case in depth and by July 2025 concluded there was no secret client list and no explosive evidence being hidden inside the sealed records, although Ghislaine Maxwell is in jail. Investigators confirmed that the majority of the documents are still locked away because of privacy laws and legal requirements not to protect anyone politically.
Even after Donald Trump returned to office his own Justice Department led by Attorney General Pam Bondi released some redacted materials like flight logs and Epstein’s contact book in February 2025. The rest of the files remained sealed for the same legal reasons. Both Biden and Trump administrations followed the exact same court rulings which shows this is not about one president shielding another but about following the law.
Despite the conspiracy theories spreading online there is no evidence that Biden intentionally kept Epstein’s documents hidden, therefore it’s not a “democratic hoax” as Trump claims. The reason the Epstein files are not public is straightforward. Federal judges sealed them to protect victims and because the law requires it. Until those judges lift the seals no president can release those documents no matter who is named in them.
