While set to begin trial in Philadelphia, Bill Cosby is firing back at the accuser who says he drugged and raped her 11 years ago.
When Andrea Constand, the accuser, went to authorities in 2005, they did not want to move forward with charges against Bill Cosby. Both Constand and Cosby ended up settling a civil suit shortly after. In 2016, Constand’s criminal case against Cosby was re-opened, just before the statute of limitations ran out. Cosby has quietly filed a lawsuit, claiming Constand has breached the contract in their civil suit.
According to Cosby, speaking to the Philadelphia police who reopened the case is as violation of their agreement. He says that Constand, who is now a resident of Canada, did not have any obligation to cooperate with Philadelphia authorities.
“Despite being under no legal obligation to discuss any aspects of the events and allegations, … and despite being expressly prohibited from disclosing such information to anyone, Andrea Constand volunteered to participate and disclosed such information to the district attorney and others,” Cosby’s lawyers wrote in a redacted version of the Feb. 1 lawsuit that was filed Thursday.
