Chrome Hearts didn’t take too well to Shein copying its ideas. A lawsuit was filed against the fast fashion giant for copyright infringement and unfair competition.
Chrome Hearts alleges it has suffered financial and reputational harm in its complaint filed in the U.S. District Court for the Central District of California last week.
The luxury label sued Shein’s U.S. subsidiaries for the “manufacture, production, marketing, distribution, advertisement, offering for sale and/or sale” of accessories that include markings that are “identical with, substantially indistinguishable from or confusingly similar” to Chrome Hearts’ trademarked logos, Hypebeast reported.
The brand’s federally registered marks consist of its Cemetery Cross Patch, the CH Plus, and the Dagger Design.
Chrome Hearts also claims that Shein intentionally “misled” consumers by creating products with its markings without “any form” of permission to use them.
“Chrome Hearts purchased and inspected the accused products and confirmed they did not originate from Chrome Hearts or contain authentic Chrome Hearts marks,” the complaint reads. “Defendants [Shein] used the Chrome Hearts marks on the accused products without Chrome Hearts’ permission.”
Chrome Heart has sold more than $1 billion worth of products that are branded with one or more of its registered marks and has issued close to 100 lawsuits against companies, including FashiNove, Guess, JC Penney, Tar, get and Walmart, for infringing on its trademarks.
It seeks to stop Shein’s manufacturing and selling of products that have its registered marks and recall the remaining products. It’s also requesting $2 million in damages, for each trademarked infringement.
