On December 1st a 29-year-old woman  accused an unnamed man of attacking her. She said that the two engaged in a “physical fight” and that she scratched his neck, face, back and shoulder before the alleged sexual assault took place. She said he also slapped her in the face before he forced him self on her. Police determined the man was McNary after  investigating a cellphone the woman claimed she took from the man’s apartment. She was also able to pick his photo out of a line-up.
Police say when they arrived to McNary’s apartment to investigate, McNary said, “I know why you’re here” and that saved evidence because he knew they were on the way. Prosecutors have filed charges of rape, criminal confinement with bodily injury and battery resulting in bodily injury. The nurse who administered a sexual assault examination found dried blood behind the woman’s ear and other injuries. A friend of the accuser also played a 2-minute voicemail from the women for police, which at one point the woman could be heard crying and distraught.
