Sean “Diddy” Combs’ legal team has requested a two-month delay in his upcoming federal criminal trial, but for now, the judge isn’t budging.
The hip-hop mogul, who is facing five federal charges, including racketeering and sex trafficking, pleaded not guilty to an expanded indictment earlier this month. His trial remains set to begin with jury selection on May 5 and opening statements on May 12.

In a letter filed April 16, Combs’ attorneys argued that newly introduced allegations and ongoing discovery—including material tied to a witness known as Victim-4—warrant more preparation time. They say the Third Superseding Indictment introduces significant new conduct and that the government is still turning over key evidence, including on a charge that carries a 15-year mandatory minimum.
Judge Arun Subramanian acknowledged the concerns but ordered both sides to continue on schedule ahead of this Friday’s court conference. He added that if Combs’ legal team submits a renewed application that addresses government objections, the court will promptly consider it.
Federal prosecutors allege that Combs used his entertainment empire to sexually abuse women over a 20-year span, including orchestrating recorded sexual encounters known as “freak offs,” which sometimes involved transporting participants across state lines.
Combs, 55, has denied all criminal wrongdoing. His lawyers maintain the relationships were consensual, and argue the allegations stem from former partners with personal motives. He has also been named in dozens of civil lawsuits.
Combs has been held in a Brooklyn detention facility since September. His defense team, led by Marc Agnifilo, may still seek a limited delay to review specific discovery materials.
