The doctor who gave documents showing she let the state of Indiana know about an abortion procedure that was provided to a 10-year-old rape victim is now moving to sue the state’s attorney general for defamation.
Last Friday, Dr. Caitlin Bernard sent Indiana Attorney General Todd Rokita a cease-and-desist letter demanding that he stop making “false or misleading statements” about her. That cease-and-desist has now been escalated to a formal defamation lawsuit.
On Tuesday, Dr. Bernard filed a tort claim, which is the precursor to a lawsuit.
This all comes after Rokita moved forward with an investigation into Dr. Bernard over her performing an abortion on a 10-year-old rape victim from Ohio who traveled to Indiana for the procedure. Prior to her filing, Dr. Bernard provided documents showing that she reported the abortion procedure to the state of Indiana.
This case sparked another level of the conversation around Roe v. Wade following its overturning by the U.S. Supreme Court last month. The 10-year-old girl was raped by a 27-year-old Ohio man named Gershon Fuentes, who confessed to raping the child.
He’s currently being held on a $2 million bond.
