Families of survivors of the tragic Robb Elementary School shooting have filed a lawsuit against UPS and FedEx, accusing the shipping giants of violating state and federal laws, as well as their own safety standards. This legal action comes on the two-year anniversary of the devastating event that claimed the lives of 19 children and two teachers.
The families argue that UPS and FedEx bear responsibility for the trauma endured by survivors. On the day of the shooting, the gunman, armed with a weapon ordered online and shipped to Oasis Firearms in Uvalde, committed the heinous act. The lawsuit contends that the companies later shipped an enhanced trigger system to the shooter, allowing him to convert the weapon into a fully automatic or semi-automatic firearm.
The families point to UPS’s own conditions of carriage, which state, “Shipments must not contain goods which might endanger human or animal life or any means of transportation,” as evidence of a violation. Additionally, they claim that shipping the Hell Fire trigger to the gunman’s house, located less than 1,000 feet from Robb Elementary School, breached school zone protections.
According to the lawsuit, the shooter was underage when he purchased the weapon and the Hell Fire trigger online. It alleges that FedEx shipped the AR-15 to Oasis Firearms, which then illegally transferred the gun to the 17-year-old shooter. The shooter also bought ammunition from Oasis, which was used in the massacre.
The lawsuit against UPS and FedEx coincides with separate wrongful death lawsuits filed by victims’ families against Meta, the parent company of Instagram, Activision, the maker of Call of Duty, and Daniel Defense, the manufacturer of the AR-15 style rifle used in the shooting.
In response, UPS issued a statement expressing condolences to the Uvalde victims and their families, emphasizing that shipping firearms and components is highly regulated. “UPS complies, and requires its customers to comply, with all applicable federal laws. The lawsuit has no merit and we will defend accordingly,” the statement read.
