A new lawsuit filed in federal court is putting Elon Musk and his artificial intelligence company under serious scrutiny. Three anonymous plaintiffs claim xAI’s Grok AI models allowed the creation of abusive sexual images using real photos of them when they were minors. The lawsuit, filed Monday in the U.S. District Court for the Northern District of California, argues that the company failed to implement basic safety protections that other AI developers use to stop systems from producing explicit content involving identifiable people and children.

According to TechCrunch, the case is titled Jane Doe 1, Jane Doe 2, a minor, and Jane Doe 3, a minor, versus x.AI Corp. and x.AI LLC. The plaintiffs are seeking to turn the complaint into a class action that could represent anyone whose childhood photos were allegedly altered by Grok into sexual imagery.

According to the filing, other deep learning image generators use safeguards designed to block the creation of child sexual abuse material from real photographs. However, the lawsuit claims those industry standards were not adopted by xAI.

One plaintiff, identified as Jane Doe 1, says images from her high school homecoming and yearbook were altered by Grok to show her unclothed. She learned about the images after someone contacted her on Instagram and shared a link to a Discord server where sexualized versions of her photos were circulating alongside images of other minors from her school.

The complaint also describes two additional incidents. Jane Doe 2 says criminal investigators informed her that altered sexual images of her were created through a third-party mobile app using Grok models. Jane Doe 3 says investigators discovered a pornographic image of her on the phone of someone they had arrested.

Attorneys for the plaintiffs argue that even when third-party apps are involved, the technology still relies on xAI’s underlying code and servers.

All three plaintiffs say the spread of these images has caused severe emotional distress and fear about long-term damage to their reputations and social lives. They are asking the court to impose civil penalties under laws designed to protect children from exploitation and to address alleged corporate negligence.

xAI did not respond to a request for comment.
