Actress Garcelle Beauvais is currently facing a lawsuit concerning a post she shared on social media.
According to court documents, the ‘Real Housewives of Beverly Hills’ star is facing a lawsuit from photographer John Carta. In the lawsuit, Carta claims that he earns a livelihood by selling his photographs to different third-party entities. In May 2022, he captured a series of pictures of Garcelle as she strolled the streets of New York.
Carta asserted that he secured a copyright for the photographs. Despite being the rightful owner of the images, he alleged that Garcelle utilized them on her Facebook page without obtaining his consent or providing any form of compensation.
“The Account is monetized in that it contains endorsements and promotes [Garcelle’s] celebrity profile and upon information and belief, [Garcelle] profits from these activities,” the suit read.
The lawsuit added that Garcelle “actively copied and/or displayed [John’s] photographs on the Account.” It also stated that the actress “engaged in this misconduct knowingly and in violation of the United States copyright laws.”
Additionally, Carta says Garcelle intentionally and deliberately violated his copyright. He claims that she directly benefited financially from the infringement, asserting that his work contributed to increased traffic on her account.
Carta aims to obtain unspecified damages for the alleged infringement. He’s requesting a court order that prevents Garcelle from unlawfully posting his work without proper compensation in the future.
