Texas State Trooper, Brian Encinia, is not out of the clear yet. Encinia, the arresting officer in the Sandra Bland case, has been indicted by a grand jury for perjury. The decision was made on Wednesday.
On July 10, Encinia made false statements along with numerous omissions, and misrepresentations in his affidavit detailing the events surrounding Sandra Bland’s arrest. The affidavit was submitted, “based upon personal knowledge” and “duly sworn…on oath.” Magistrate Dolores Hargrave relied on Trooper Encinia’s affidavit to find both probable cause for the issuance of an arrest warrant for Sandra and to determine Sandra’s bail.
In December a grand jury declined to indict jail staff or any members of the Waller County Sheriff’s Office. Jurors still have not issued any decision on Brin Encinia’s treatment or arrest of Bland.
