The Illinois Supreme Court has agreed to review actor Jussie Smollett’s criminal conviction stemming from his role in orchestrating a 2019 attack and providing false information to Chicago police.
On Wednesday, the court accepted Smollett’s appeal of his 2021 conviction, which the state appellate court upheld in December.
So far, no date has been scheduled for the high court to hear arguments on the matter.
A special prosecutor refiled charges against Smollett after Cook County State’s Attorney Kim Foxx dropped the case. Smollett forfeited his $10,000 bond and completed community service, which he argues ended the case.
The state’s First District Appellate Court, in a 2-1 decision, rejected Smollett’s claims, stating that he wasn’t promised immunity from further prosecution after accepting the original deal. Justice Freddrenna Lyle dissented, deeming the refiled charges “fundamentally unfair.”
Jussie remained defiant after the verdict, and despite being sentenced to 150 days in jail, he only served six days before his release due to his ongoing appeal process.
