Comedian-actor Kevin Hart has filed to have his sex tape legal battle thrown out.
New court documents obtained by the Blast state Hart is asking a federal judge to dismiss the lawsuit filed against him by Montia Sabbag. Sabbag is the woman Hart had an affair with back in 2019. Hart and Sabbag’s encounter was captured by a hidden camera and leaked, escalating the affair into an all-out scandal. ⠀⠀⠀
Sabbag sued Hart for $60 million, claiming he leaked their sex tape with the mission to promote his projects. But in new documents, Hart claims Sabbag never filed legal papers against him, which were needed for her case to progress. Hart says Sabbag hired a process server who visited his home but didn’t actually serve him correctly, The Blast reports. Hart says the server “simply threw a set of papers out of a car window in view of a security guard” outside the gate at his home. The docs claim the security guard ”took photos of the legal docs laying in the middle of the street.”
In addition, Hart says Sabbag didn’t follow specific court rules and now wants to the entire case to be dismissed. However, Sabbag maintains her belief that Hart plotted with a friend to secretly film the two having their affair and claims that Hart wanted the sex tape leaked to the public. Hart denies her allegations, calling them “baseless.”
Sabbag’s original complaint read, “MS. SABBAG had no knowledge that the intimate activity depicted in the VIDEO was being recorded. To the contrary, MS. SABBAG believed that such activity was completely private, and she had a reasonable expectation of her privacy in HART’S private bedroom suite at the COSMOPOLITAN, and she reasonably believed that her privacy was safe and protected at all relevant times.”
