Singer Kevin McCall has filed for joint custody of his daughter with ’RHOA’ star Eva Marcille.
According to TMZ, McCall’s lawyer filed legal documents in an Atlanta court, claiming Eva’s tried to alienate their daughter from him ever since she moved from Los Angeles to Georgia on October 2015.
Kevin is requesting a change to their previous custody order, so that the couple can share joint legal and physical custody of their 5-year-old daughter Marley Rae, claiming that it would be in the child’s best interest for them to spend more time together and “foster a parental bond.”
McCall is also seeking to change Marley’s last name to McCall, a move that comes after Eva changed her last name to Sterling (the last name of her husband, Michael Sterling) last month.
In addition, TMZ claims that Kevin wants the court to figure out an appropriate child support arrangement for the former couple.
A rep for Eva told TMZ, “Kevin was given an ample amount of time to petition any action and never did,” citing a long list of court documents — previously filed by Eva –that Kevin never responded to.
Just three days ago, McCall was charged with domestic violence for an incident that took place in January of 2019.
In April, McCall was arrested by the Los Angeles Sheriff’s Department and taken into custody and booked on one felony count of injuring a spouse or cohabitant.
A hearing was scheduled for August but McCall did not appear. The court records revealed a bench warrant was held and the hearing was rescheduled for next month. The records also show the alleged incident went down on January 14, 2019, and the alleged victim’s identity has not been released.
