Pennsylvania prosecutors are asking the United States Supreme Court to review Bill Cosby’s case. They claim he was never given immunity in the Andrea Constand case and should still be in prison.Â
TMZÂ obtained legal documents that show that prosecutors are asking for the ruling that set Cosby free to be looked at. They are calling it a “grievous wrong.”
The appeal argues Cosby was not given lifetime immunity from prosecution just because he was not criminally charged at the time.
Cosby was released in June after the Pennsylvania Supreme Court overturned his conviction on the grounds he should not have been charged. The comedian reportedly made an agreement with the former district attorney that he wouldn’t be charged in the Constand sexual assault case if he testified. During the testimony at the civil trial, Cosby made incriminating statements about drugging women.Â
“This is a pathetic last-ditch effort that will not prevail,” Cosby spokesperson Andrew V. Wyatt wrote in a statement to NPR. He called Steele’s “fixation” Cosby “troubling.”
The Supreme Court is asked to hear more than 7,000 cases a year. They typically only take between 100 to 150 appeals each year. This equates to less than one percent, meaning it’s not likely Cosby’s case will be heard.
