The Supreme Court has announced that Donald Trump has the right to remain on a state’s presidential ballot.
On Monday, the Supreme Court ruled unanimously in favor of Trump. The move came after the former president had been battling it out with the state of Colorado, which wanted to remove him from the state ballot. Colorado cited Trump’s role in the January 6th, 2021, capitol riots as a reason for him to be disqualified from the election.
In their petition, Colorado cited the insurrection clause to keep him out of the November presidential race. However, they ruled this was not a state’s decision. Instead, the Supreme Court stated that disqualifying Trump from state ballots would have to come from Congress.
“For the reasons given, responsibility for enforcing Section 3 against federal officeholders and candidates rests with Congress and not the States,” the Supreme Court formerly wrote.
Other states will now likely have a difficult time implementing a Trump ban on their ballots. Illinois and Maine have both moved to remove Trump from ballots, stating that his efforts to overthrow the 2020 election should ban him from the presidency. Trump has appealed the decision in these states as well. In total, 36 states have filed challenges to Tump’s eligibility for the forthcoming election. With the Supreme Court ruling in his favor with the Colorado case, it’s likely he will come out victorious in those cases as well.
