The courts have spoken. Again. And they are not playing favorites. A federal judge just ruled that Donald Trump’s decision to send the U.S. military into Los Angeles during immigration-related protests earlier this year was flat-out illegal. This comes after multiple other federal courts have also ruled against Trump’s actions during both of his terms in office.
The most recent ruling, delivered by U.S. District Judge Charles R. Breyer, says the Trump administration violated the Posse Comitatus Act. That law specifically prohibits federal military forces from performing domestic law enforcement functions. The judge made it clear that the administration did not follow the proper legal process, such as invoking the Insurrection Act, which could have made the deployment legal under a state of emergency. Instead, the military was used for things like perimeter security, traffic control, and helping ICE with immigration operations in Los Angeles neighborhoods. The judge issued an injunction, barring these military forces from continuing in any law enforcement role.
Although the ruling does not demand immediate withdrawal of all troops from Southern California, it sharply limits what they can do. They are now restricted to protecting federal buildings and personnel only. No more traffic stops. No more raids. No crowd control.
This is not the first time Trump’s use of executive power has run into a wall in the courts. Let’s take a look at several other major cases where federal judges ruled that Trump or his administration acted illegally.
Illegal Tariffs Through Emergency Powers
In one of the biggest trade-related rulings, a federal appeals court struck down Trump’s attempt to impose sweeping global tariffs under the International Emergency Economic Powers Act, or IEEPA. The court said the president cannot use emergency powers as a shortcut to bypass Congress and change economic policy. Tariff authority lies with Congress, not the president. Trump’s administration argued it was a national emergency, but the court ruled there was no legal basis to support that claim.
The case is now headed to the Supreme Court. If the high court agrees with the lower courts, it could not only cement the ruling as law but also expose the administration to further legal scrutiny if they intentionally bypassed legal processes.
Using the Alien Enemies Act for Deportations
In another federal courtroom, Trump’s own appointed judge ruled that the administration could not use the Alien Enemies Act to deport Venezuelan immigrants without due process. That act requires a formal declaration of war, which was never issued. The judge noted that the Trump administration lacked the legal authority to carry out mass deportations using a statute intended for wartime enemies. The ruling put an immediate stop to those deportations and forced ICE to restore due process rights.
This case not only blocked the deportations but also raised concerns about the Trump administration’s repeated attempts to stretch the meaning of old laws to fit modern political goals.
Multiple Executive Orders Found Likely Unconstitutional
According to court records reviewed by the Washington Post, over a dozen judges have flagged Trump-era policies as likely illegal. This includes attempts to defund diversity training in federal agencies, suspend asylum processes without congressional approval, and reallocate military funds without legal authority.
Judges from across the country, including those appointed by Trump himself, ruled that the administration repeatedly acted without legal basis. Some of these rulings included temporary restraining orders, while others permanently blocked Trump’s actions from being enforced.
Could Trump or His Administration Face Jail Time?
Here’s where things get complicated. While courts have ruled that many of Trump’s actions were illegal or unconstitutional, that does not automatically mean criminal charges will follow. Most of these cases are civil, not criminal. Civil cases determine whether an action was lawful, not whether someone should be jailed.
However, there could be criminal consequences in the future, especially if evidence emerges that laws were knowingly broken or if orders were given with the intent to violate the Constitution or statutes like the Posse Comitatus Act. Legal experts say that if future investigations prove that members of the Trump administration ignored legal advice or covered up their actions, then criminal liability could come into play. But for now, no one has been criminally indicted in these specific cases.
Trump himself is also facing multiple unrelated criminal indictments at the state and federal level, including for obstruction of justice and handling of classified documents. Those are separate matters, but they contribute to an ongoing legal spotlight surrounding his conduct.
Conclusion
Presidential power is not unlimited. Whether it is unauthorized military use, cutting legal corners with deportations, or overstepping trade authority, the legal system keeps pushing back.
While Trump may not be facing jail time for these specific rulings just yet, the number of times his policies have been called unlawful continues to grow. The court system is watching, and so is the public.

By their lack of actions to defend the rules and limitations laid down in the constitution, the republican controlled congress has given it’s consent for Trump to ignore the constitution. Plausible deniability for violating their oaths of office. Since the majority of the federal government’s authority resides with the two houses of government, the senate and the house of representatives as laid down in the constitution and since both have done nothing to enforce the rules within the constitution, they have all (the GOP senators and representatives and the president) violated their oath of office to defend and protect the constitution. Making them all guilty of treason.
If no one enforces the constitution, we do not have a constitution. And if Donald Trump is allowed to violate and/or create any laws he desires to, we already have a king now.
Trump is guaranteed to interfere in every future election and congress and the Supreme Court will enable it if past events are any indication. What will we do if Trump refuses to admit defeat either his own or any republican defeats.? Trump is only a few seats short of amending the constitution or discarding it entirely. If the election hangs in the balance for too long, civil war would break out eventually, it would have to. This is the risk Donald Trump poses very soon now.
