A woman is suing GEICO for $1 million after contracting HPV during car sex in a vehicle insured by the company.

In the absurd lawsuit, the woman identified as M.O. had a sexual relationship with M.B., a 2014 Hyundai Genesis owner. The two engaged in unprotected sex in late 2017 in M.B.’s car. During the rendevous, M.O. contracted anogenital human papillomavirus (HPV). HPV is the most common sexually transmitted infection, with symptoms including but not limited to warts on the genitals or surrounding skin.

On October 4th, GEICO filed court documents, seeking a declaratory judgment to determine their obligations for M.B. infecting the woman inside of the car.

M.B. and M.O. had previously agreed to restrict M.B.’s liabilities in exchange for M.O. being free to pursue GEICO for recovery. On the other hand, the insurer claims that they were unaware that the two had gone to arbitration, resulting in M.O. being awarded $5.2 million. M.O. is still seeking another $1 million from GEICO.

U.S. Magistrate Judge Angel D. Mitchell ruled that M.O. and M.B. cannot have their identities withheld in litigation. The judge said that the individuals would be granted anonymity until she rules on M.O.’s motion to dismiss. Once that has passed, GEICO must file a second amended complaint identifying the defendants by their real names, or Mitchell will recommend the case be dismissed.
