The Supreme Court is stepping into one of the biggest legal showdowns of Trump’s second term, agreeing to hear the fight over his attempt to end birthright citizenship for children born in the United States to noncitizen parents.

Trump signed the executive order on day one of his new term, aiming to block automatic citizenship for babies born to undocumented immigrants and people in the country on temporary status. The move challenged more than a century of established constitutional law, including the 1898 ruling that confirmed nearly all children born on U.S. soil are citizens.

Lower courts shut the order down almost immediately, calling it unconstitutional and a direct violation of the 14th Amendment. Multiple judges held that presidents don’t have the authority to erase birthright citizenship through executive action, which is why the policy has never taken effect.

Now the case is heading to the Supreme Court, where justices will decide if Trump’s order can stand or if it breaks the very amendment that defined modern American citizenship. Arguments are expected in spring 2026, with a ruling set for early summer. Until then, birthright citizenship remains unchanged.

Civil rights groups say the order puts the status of hundreds of thousands of U.S.-born children at risk and threatens generations of legal precedent. Supporters of the ban say it’s needed to address what they claim are exploitation issues tied to immigration.

The Court’s decision could permanently shift how America decides who belongs, and the outcome has the potential to reshape the definition of citizenship itself.
