A previously undisclosed part of Kroy “KJ” Biermann Jr.’s legal history is receiving fresh attention as prosecutors ask a judge for permission to conduct forensic interviews with unidentified minors in his ongoing felony case.
According to TMZ, prosecutors filed an emergency motion asking the court to order forensic interviews of “minor children.” The publicly available docket does not identify the children, disclose how many prosecutors want interviewed, or explain what information investigators believe they may have.
That distinction is important. Nothing publicly released so far identifies the minors as KJ’s siblings, relatives, additional alleged victims, or witnesses. FOX 5 Atlanta reported that the filing offers no details about their identities or what they might know. Forensic interviews generally involve specially trained professionals conducting structured conversations with children in an effort to gather information while reducing repeated questioning.
The emergency request comes shortly after another major revelation in the KJ Biermann case. At a September bond hearing, prosecutors said the 15-year-old had already been under court supervision in connection with a separate juvenile sexual battery matter before his current arrest. Prosecutors said the earlier case had remained out of public view because it was handled in juvenile court and that KJ had been under supervision since October 2025.
Prosecutors also made additional allegations connected to the earlier matter during the bond hearing. According to Entertainment Weekly, the state alleged that investigators discovered videos on KJ’s cellphone involving sexual activity with a younger family member. Prosecutors argued that the prior juvenile history was relevant as the court considered whether KJ should be released while his current case moves forward.
KJ’s attorney, Jason Sheffield, has strongly disputed the prosecution’s description of that earlier case. In a statement reported by TMZ, Sheffield said, “The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.” The defense has maintained that the prior matter involved inappropriate conduct between middle school aged children and did not end with the type of adjudication prosecutors’ presentation might suggest.
The current criminal case centers on allegations involving a female classmate and an incident prosecutors say occurred April 23, 2026, at a fitness center in Alpharetta, Georgia. KJ was arrested August 17 and later indicted on seven felony counts, including aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under 16. The allegations have not been proven in court.
Police records described by WSB TV show that authorities began investigating after an officer responded to a hospital following a report of sexual assault. Investigators said the alleged encounter occurred at a gym in Alpharetta. KJ has denied the accusations through his legal team.
Kim Zolciak has also publicly defended her son. Following his arrest, she told Us Weekly, “The allegations being made against my son are nothing short of reckless and deeply troubling.” Zolciak has said KJ denies the allegations and has pointed to what she described as a voluntary polygraph examination and DNA testing as reasons she believes the accusations are false. Those defense claims do not resolve the criminal charges, which remain pending in court.
KJ was initially detained after his August arrest, but a judge later set his bond at $200,000. The release conditions include electronic monitoring, virtual schooling, no cellphone or social media use, and restrictions preventing him from contacting the alleged victim or anyone age 16 or younger.
The bond order requires KJ to stay at his mother’s Alpharetta residence and prevents children under 16, including younger siblings, from living at or visiting the home while those conditions are in place. Those restrictions were imposed before the newly reported emergency motion seeking forensic interviews became public.
The timing now puts two developments side by side in the KJ Biermann case. Prosecutors have publicly revealed that he was already under court supervision from a separate juvenile matter when the allegations behind his current prosecution surfaced, and they are now seeking permission to have trained professionals interview unidentified “minor children.”
