The family of a Los Angeles woman named Elizabeth has filed a lawsuit against an LAPD officer, alleging he behaved inappropriately with her body after she died, according to the NY Daily News and other outlets.
The suit was filed Tuesday in Los Angeles. It names Officer David and the City of Los Angeles and alleges invasion of privacy, intentional infliction of emotional distress, mishandling of human remains and other claims. The family says David and his partner responded to a 911 call at her home on October 20, 2019, after she was found dead. The suit alleges David turned off his body camera and touched her body while alone with her, and that the footage was later viewed by others. The suit also notes body cameras keep recording for up to two minutes after they are powered off.
At a news conference, family attorney Gloria Allred said the family was disturbed to learn the video had been seen by others and fears it could resurface. Elizabeth’s mother, Janet, said, “I am infuriated that this man had so little respect for another human being.”
The officer has been charged with one felony count of having sexual contact with human remains without authority. He was released on bail and pleaded not guilty. An LAPD spokesperson said he remains employed but was suspended in December. The Los Angeles Police Protective League, the officers’ union, declined to pay his legal bills. No response from the officer or his attorney was included in reports. The allegations in the lawsuit have not been proven in court.
