Model and “Real Housewives of Atlanta,” star Eva Marcille says her ex Kevin McCall is using his custody suit to harass and stalk her.
McCall filed legal documents on Oct. 29, seeking custody of the former couple’s five-year-old daughter Marley Rae. Adamma Mckinnon, McCall’s attorney, filed the legal documents alleging that Marcille has been keeping him away from Marley ever since moving to Georgia back in 2015.
Now, McCall is demanding that the custody agreement between them be amended so the two can both have legal and physical custody of Marley. McCall believes it’s in their daughter’s best interest for them to spend more time together and “foster a parental bond,” TMZ states. In addition, McCall wants Marley Rae to take back his last name despite having previously said that he no longer wanted Marley Rae. The child currently shares the same last name as her step-dad – Marcille’s husband – Michael Sterling.
“Kevin was given an ample amount of time to petition any action and never did,” says Marcille’s rep. The rep also alleges that Marcille has previously filed custody documents that McCall has yet to respond to. The two have had an ongoing tumultuous relationship seemingly ever since they broke up. Back in 2014, Marcille was granted a restraining order against the singer after he allegedly went on a rampage in their home and tried to grab their daughter out of Marcille’s hands.
In the lawsuit, Marcille said McCall was physically abusive to her and has bragged that he “could do worse damage” than mass shooter Chris Dorner. She also said McCall never financially supported Marley and refused to take the court-ordered parenting classes that he was required to as part of their Los Angeles case. She added the judge, in that case, issued a permanent restraining order that bars contact between him, her and the child – and it should stay that way.
Marcille feels that joint custody would only upset Marley and disturb their happy home. She also included some of McCall’s social media posts, where he refers to himself as a “ticking time bomb” and threatening texts she said were from him. McCall had not responded to Marcille’s answer as of Oct. 30, Bossip reports.
