Mary Moore’s case is getting fresh attention nearly four years after the former Clayton County jail employee was arrested over a sexual relationship with an inmate, and this time Moore is telling the public how she says the conviction has affected nearly every part of her life.

Moore, who was 21 when she was arrested in September 2022, is now publicly challenging the sex offender label she says followed the case. Her story resurfaced across social media this week as she described housing instability, motherhood and restrictions that she says have prevented relatives from simply giving her and her son a place to stay. A social media post recirculating her case on September 16 drew thousands of interactions within hours.The original case dates back to the Clayton County Jail. According to WSB TV’s September 2022 reporting, investigators accused Moore of engaging in sexual acts with a detainee in the doorway of a control tower inside one of the jail’s housing units. Law enforcement told the station that surveillance cameras captured the encounter and said Moore confessed. She was released on a $5,000 bond after her arrest.
A month later, WSB TV reported on an internal jail memo that identified Moore as a fired security specialist and said video showed her having what officials described as an improper sexual relationship with an inmate.
Moore is giving a much more personal account now. In her GoFundMe campaign, titled “Help Mary and Son Find Stability”, she says she was convicted in 2024 and labeled a sex offender after falling in love with an adult inmate. Moore describes the relationship as “mutual and consensual” and claims text messages and jail phone calls would support her version of the relationship. She also says her offense was “not related to sexual assault.”
Within this viral situation, which has attracted over 800,000 views on TikTok, there are two separate legal questions.
The first is whether an adult correctional employee could legally engage in sexual conduct with an adult inmate who agreed to the relationship. Under Georgia law in effect when Moore was arrested, the answer was no. Georgia Code Section 16 6 5.1 stated that an employee or agent could commit improper sexual contact by engaging in sexual conduct with someone the employee knew was being detained by the employee’s law enforcement agency or held in the correctional facility where the employee worked. Most importantly for Moore’s current argument, the statute expressly stated that the victim’s consent was not a defense.
That means Moore saying both people were adults and that the relationship was consensual does not, by itself, establish that the underlying conduct was legal. Georgia law placed the responsibility on the employee because of the custodial relationship between a jail worker and a detained person.
The second question is more complicated: Did Moore’s specific conviction and sentence legally require her to register as a sex offender?
Georgia’s 2024 sexual offender registry statute included certain first- and second-degree improper sexual contact convictions under Section 16 6 5.1 within its definition of a dangerous sexual offense. However, the law also contains an exception tied to whether the punishment imposed was subject to Georgia’s separate sexual offender sentencing statute. That distinction makes the exact offense Moore was convicted of and the sentence she received important. Without her judgment and sentencing documents, Baller Alert cannot independently determine whether the registration requirement she is challenging was correctly applied in her case.
What is clear is why registration can create an enormous housing problem in Georgia. Under Georgia Code Section 42 1 15, a person required to register because of an act committed after July 1, 2008 generally cannot live within 1,000 feet of a child care facility, church, school, or an area where minors congregate.
Moore says those restrictions have had real consequences. In her fundraiser, she claims she spent time living in a trailer behind her sister’s home because she could not stay inside the house with her sister’s children. She says the trailer had no running water and that she used a gym to shower. Moore also says that after her son was born, her father and his wife offered to let them stay at their home, but she could not move in because a church was within 1,000 feet of the property.
She further alleges that Clayton County threatened to take her son away and says she petitioned the court before giving birth for release from probation because of the restrictions she was facing. Moore wrote in the fundraiser that she had gone more than two months without receiving a response. Baller Alert has not independently verified either the alleged threat involving her child or the current status of that petition.
One detail should not become social media speculation. Nothing in Moore’s fundraiser, the original news coverage, or the other sources reviewed by Baller Alert establishes that the former inmate is the father of her son. Moore does not make that claim in the fundraiser, and there is no verified basis to connect her child to the inmate involved in the 2022 case.
Moore launched the GoFundMe on August 25, 2026, saying she wants enough stability to secure housing, pay off her truck, and begin a business that can support her and her son. As of September 16, the campaign had raised $2,035 toward a $7,000 goal through 128 donations.
Her case now sits in a complicated space between the story gaining traction online and what Georgia law actually says. Moore can maintain that the relationship was consensual while the law can simultaneously treat sexual conduct between a correctional employee and someone in custody as an offense for which consent offers no defense. Whether the separate sex offender registration requirement was properly imposed on Moore is a more specific legal issue, and one that cannot be responsibly settled without the conviction and sentencing records she is now effectively asking the public to question.
