Fivio Foreign is free after completing a six-month stay behind bars.

The rapper walked out of custody on August 1 after a judge sentenced him to time served and three years of probation.

The sentence came after negotiations that prevented a much longer prison term. Attorney Adam Lustberg explained that Fivio had faced a mandatory minimum of five years and the possibility of up to 20 years because of his record. The outcome was considered favorable in light of the initial charges.

The case began on New Year’s Eve when an encounter in New Jersey led to serious accusations. Prosecutors said a woman asked Fivio for help jumpstarting her car. She alleged that instead of assisting, he pointed a gun at her and said, “If I see you parked in front of this building again there is going to be a fucking problem.”

On January 18, Fivio was arrested in New Jersey. The charges included unlawful possession of a weapon, aggravated assault, and terroristic threats. He remained in custody for 196 days while the legal process continued.

In May, he entered a guilty plea to third-degree terroristic threats, which involves making a threat to commit a violent crime. The plea agreement credited the time he had already served and replaced a potential prison term with probation.

Fivio will now complete his three-year probation under the supervision of New Jersey authorities.
