Kevin Hart Says Ex Assistant Named His Sex Tape Partner as a Witness Just to Embarrass Him

The comedian wants a judge to keep Montia Sabbag off the stand in his lawsuit against former assistant Miesha Shakes, arguing she has nothing to do with the case.

The Kevin Hart sex tape scandal is back in a courtroom nine years later, and Hart is asking a judge to keep the woman from that 2017 video off the witness stand. In new court documents, Hart accuses his former assistant Miesha Shakes of naming Montia Sabbag as a potential witness for one reason only: to embarrass him and stir up a scandal.

The filing comes just days after Shakes listed Sabbag on her witness list in the lawsuit Hart brought against her. Shakes said she wants to question Sabbag about the recording and the investigation that followed it. She also plans to take the stand herself and call Hart to testify.

Hart is not having it. He argues Shakes never conferred with his legal team about her witness list before submitting it, which he calls improper. He is asking the court to block Shakes from calling witnesses he considers irrelevant, Sabbag included. According to Hart, only three people matter in this case: himself, Shakes, and Tasha K. Anyone else, he says, should be barred from testifying unless Shakes can prove what they would say actually relates to the claims.

The case centers on the tell all interview Shakes gave Tasha K in December 2023. Shakes, who worked for Hart from 2017 to 2020, spoke about his personal life during the sit down, including claims about his marriage. Hart sued, saying the interview violated a nondisclosure agreement Shakes signed when she left his company and damaged his reputation. In June 2026, he asked a judge to order Shakes to pay $50,000 under the damages provision in that agreement.

Shakes has fired back on two fronts. She argues the nondisclosure agreement is invalid because Hart failed to hold up his own obligations under the deal. She also says Hart cannot blame her for hurting his reputation when his own conduct already did that, and she points directly to the Kevin Hart sex tape as her example. That argument is exactly why she wants Sabbag in the room.

Sabbag has her own history with Hart in court. The recording was made in a Las Vegas hotel room in 2017, and the fallout turned into an extortion investigation. Sabbag has acknowledged she appears in the video but denied any role in making it or in any extortion attempt. In 2019, she sued Hart for $60 million, alleging she was recorded without her consent. Hart denied the allegations, and that lawsuit was eventually dismissed. Hart’s former friend Jonathan “JT” Jackson was charged with extortion in connection with the tape, but those charges were later dropped.

Shakes naming Sabbag does not reopen that old lawsuit. It does, however, threaten to drag every detail of the Kevin Hart sex tape back into public record if a judge lets her testify.

A judge has not yet ruled on Hart’s request, and Sabbag has not said whether she would take the stand. Hart is seeking unspecified damages from Shakes, and the case remains ongoing.
