The family of Botham Jean has filed an appeal on Friday as they believe the City Of Dallas should be held accountable for the wrongful death of Jean, according to ABC News.
Botham Jean was killed on September 6, 2018 by off duty Dallas Police patrol officer Amber Guyger, as he sat in his own home watching television.
On Thursday, a U.S. District Judge dismissed the city from a civil lawsuit filed by Jean’s family. “To get this news the day after Christmas was very difficult for the family,” said family lawyer Daryl Washington. “They know we have a fight ahead of us. And they’re just prepared to do whatever it takes to get some type of justice for Botham and their family.
However, Guyger remains the sole defendant on the lawsuit. She is currently housed in Mountain View Correctional Facility in Gatesville and will be eligible for parole in 2024, according to online records.
Amy L. Messer, the senior assistant city attorney for Dallas, declined to comment to ABC News on the dismissal.
